We understand that we need to update our labor law posters in California. Can you please tell us more about the laws that pertain to these posters?
Sure. As you probably know, there are specific laws regarding labor law posting requirements in California. California employers are required to display labor law posters that reflect specific California state requirements as well as federal requirements.
As far as those basic posting requirements go, you are required to display your labor law posters in an area of your workplace that is clearly visible and accessible to all employees. Many employers choose to post their notifications in an employee break room, where employees will be able to review their rights at their own discretion.
You are also required, as you know, to update these posters as the laws change. The federal minimum wage law changed for 2007, so employers across the country are required to update their posters to stay compliant. You must also replace your poster if it is damaged or removed. A great place to buy all of the labor law posters that you need for your California workplace is www.laborlawcenter.com.
Here are the specific California state labor law posting requirements that you need to meet:
Discrimination Notice
Minimum Wage
Family Rights Act (Notices A and B)
Unemployment Insurance
OSHA-Health and Safety Protection
Access to Medical and Exposure Records
State Disability Insurance
Workers Compensation
Payday Notice
Time Off for Voting Notice
Emergency Phone Number
Whistleblower Protection Act
Smoking Policy
Edd UI, SDI, PFL Notice
Here are the federal labor law posting requirements:
Federal Minimum Wage
USERRA – Uniformed Services Employment and Reemployment Rights Act
Equal Employment Opportunity is the Law
Employee Polygraph Protection Act
Family and Medical Leave Act
OSHA – Job Safety and Health Protection
IRS Withholding Notice
Payday Notice
Anti-Discrimination Notice
Keep in mind that you need to update your posters immediately for 2007 if you have not already done so. Because the federal minimum wage was increased in the summer of 2007, it is important that you update your posters as soon as possible so that you can be compliant with the federal and state labor law posting requirements.
