We heard that there are certain rules about the labor law posters and what we need to post in our Illinois office. What are those rules?
Yes, there are specific labor law posting requirements that you need to abide by in order to ensure that you post the labor law notifications according to the federal and the Illinois state law. Across the country, employers are required to post both federal and state labor laws that apply to their companies. However, you may not have to post the laws that to not directly apply to your company. For example, if your company is too small to be covered under the Family and Medical Leave Act, then you do not have to post the FMLA requirements.
General posting requirements are as follows:
- You need to post both the Illinois state and the federal labor law requirements.
- These requirements can be on the same poster, or you can have a separate poster for the state labor law requirements and the federal labor law requirements.
- You need to be sure that these posters reflect the most up-to-date labor laws, so whenever a labor law changes, you need to update the labor law poster.
- It is important that these labor law posters are in a highly visible place in the workplace, such as an employee break room.
- The posters need to be replaced if they are either damaged or removed from the workplace.
Here are the labor law notification requirements that are specific to the state of Illinois:
- Emergency Care
- Victim’s Economic Security and Safety Act
- Equal Pay Act of 2003
- Unemployment Insurance
- Right-to-Know
- Minimum Wage
- Workers’ Compensation
And here are the federal labor laws that you are required to post:
- New 2007 Federal Minimum Wage
- USERRA – Uniformed Services Employment and Reemployment Rights Act
- Equal Employment Opportunity is the Law
- Employee Polygraph Protection Act
- Family and Medical Leave Act
- OSHA – Job Safety and Health Protection
- IRS Withholding Notice
- Payday Notice
- Anti-Discrimination Notice
