What labor law notification posting requirements should we be aware of for our Indiana workplace?

Your labor law notification requirements in Indiana will be basically the same as the labor law notification requirements across the state, with the exception of some of the Indiana-specific labor law posting notification requirements. Here are the general guidelines that you need to follow in order to be compliant with Indiana-state and federal laws:

  • You need to post the Indiana-specific and the federal labor law notifications. These notifications may appear on the same poster, or they could come on separate posters.
  • The labor law posters need to be placed in an area of the workplace that is accessible and clearly visible to all of your employees. Often, such an area is the employee break room.
  • In the event that a labor law poster is either damaged or removed from the posting site, it is up to the employer to replace that poster promptly.
  • Employers may not discriminate against or punish employees from inquiring about their labor law rights. Employers should always let their employees know that they can view their rights at their own leisure on the labor law posters.
  • Employers should also make sure that when a labor law is changed, the employers update the labor law posters. For example, the federal minimum wage was updated in 2007, so employers across the country need to be sure that they have the most updated versions of the labor law posters for their workplaces.

In terms of the Indiana-specific labor law notification requirements, you must post the following:

  • Minimum Wage
  • Discrimination Notice
  • Workers’ Compensation
  • Unemployment Insurance
  • USHA – Health and Safety Protection
  • Child Labor Law
  • Workforce Development Act

You must also post the following federal notifications:

  • The new 2007 minimum wage requirement
  • USERA – Uniformed Services Employment and Reemployment Rights Act
  • Equal Employment Opportunity is the Law
  • Employee Polygraph Protection Act
  • Family and Medical Leave Act (FMLA)
  • OSHA – Job Safety and Health Protection
  • IRS Withholding Notice
  • Payday Notice
  • Anti-Discrimination Notice
