What are the labor law posting requirements for the state of New York?
The labor law posting requirements in New York are going to be very similar to the labor law posting requirements for states across the country. However, the major difference between each state has to do with the specific labor laws that are required by each state. In general, you should keep the following information in mind when going about posting the labor law requirements for New York:
- All employers are required to post both the state and the federal labor laws that apply to their businesses. With this in mind, however, not all state or federal labor laws will apply to your business. As such, you are not required to post those labor laws that do not apply, though they might come bundled on a labor law poster.
- Employers may post the state and federal labor laws on the same poster, or they may separate them into two different posters. Posters can be found at www.laborlawcenter.com.
- Employers are responsible for ensuring that the labor law posters are up to date with the latest information about labor laws.
- If a labor law poster is their damaged or removed, it is up to the employer to ensure that the labor law poster is promptly replaced.
As for the specific labor law posting requirements for New York, you are required to post the following:
- Right-to-Know
- Clean Indoor Air Act
- Workers’ Compensation
- Unemployment Insurance
- Disability Benefits
- Discrimination Notice
- Time off to Vote Notice
- Minimum Wage
- Child Labor
- Child Labor Law Summary of Work Hours
- Fringe Benefits Notice
- Deductions from Wages Notice
- Tip Appropriation Notice
And the federal labor laws that you are required to post include the following:
- New 2007 Federal Minimum Wage
- USERRA – Uniformed Services Employment and Reemployment Rights Act
- Equal Employment Opportunity is the Law
- Employee Polygraph Protection Act
- Family and Medical Leave Act
- OSHA – Job Safety and Health Protection
- IRS Withholding Notice
- Payday Notice
- Anti-Discrimination Notice CB
