We are interested in learning more about the labor law posting requirements for our firm in Ohio. Can you clue us in?
Of course. Your Ohio firm will have to follow the same basic labor law posting rules that other businesses in other states have to follow, except that you will have to post specific Ohio labor laws that are required by your state. Here are some general guidelines that you will need to follow when posting your labor law notifications:
- Employers are required to post both the state and the federal labor laws that apply to their businesses. However, if there is a labor law that does not apply to your business (if your firm is too small for the Family Medical Leave Act coverage, for example), then you do not have to post information about that particular labor law.
- Employers may post both the state and the federal labor laws on one poster, or they may post them on separate posters. However, these labor laws need to be up-to-date with any changes. A great resource for labor law posters is www.laborlawcenter.com.
- Make sure that whenever a labor law changes, you post the most current version of the law on your posters. In Ohio, the minimum wage increased in 2007 to $6.85, so you will want to be sure that you have a labor law poster that reflects that increase. The federal minimum wage also increased in 2007, so if you have two separate posters, you will need to replace them both.
- It is important that the labor law posters are displayed in an area that is clearly visible to all employees, such as an employee break room or on a public bulletin board.
Here are the specific Ohio labor laws that you will be required to post:
- Unemployment Insurance
- Rebuttable Insurance Notice
- Workers’ Compensation
- Public Employee Risk Reduction
- Minimum Wage
- Minor Labor Laws
- Discrimination Notice
- No Smoking Notice
And here are the federal labor laws that you will be required to post: New 2007 Federal Minimum Wage
- USERRA – Uniformed Services Employment and Reemployment Rights Act
- Equal Employment Opportunity is the Law
- Employee Polygraph Protection Act
- Family and Medical Leave Act
- OSHA – Job Safety and Health Protection
- IRS Withholding Notice
- Payday Notice
- Anti-Discrimination Notice CB
