Does the ADA affect companies in North Dakota?
The Americans with Disabilities Act does apply to companies in the state of North Dakota, as it does to employees and employers in all states around the country. If an individual has a disability, the employer is not legally able to discriminate against the employee during any time when an employment-related decision is being made. For example, the employer may not discriminate against the employee during any hiring, promotion, termination, training, or other time at work.
Additionally, the ADA requires that employees with disabilities receive the same compensation as other employees with the same qualifications and job titles.
When an employee with a disability is hired, the employer must make every reasonable accommodation for that employee and his or her disability. For example, if the employee is in a wheelchair and requires a lower desk, the employer must provide a lower desk for the employee, if it is possible for the employee to have a lower desk.
A disability is any physical or mental impairment that limits a person’s mobility or major life activities. For example, the person could have a physical impairment that makes it difficult for him or her to be mobile.
Depression or alcohol addiction are examples of mental disabilities that are covered by the ADA. If an employee needs to take time off of work to tend to the depression, that time off may be covered under the ADA. Also, some accommodations may be made for employees that need to seek treatment for drug or alcohol addictions in rehab.
Not all companies will be covered by the ADA. In fact, only those companies that have at least 15 employees are covered. Those 15 employees may include part-time employees, as long as those part-time employees have worked for the company for at least 20 calendar weeks out of the preceding year. CB
