		<description>Hi Larry! Yes, the janitor needs to be paid at least the minimum wage for the hours that he actually works each week. 
A janitor is a non-exempt employee and does not qualify for the Belo plan or fluctuating work week. However, he is covered under applicable state and federal minimum wage laws. 
To make processing payroll easier, you can pay this employee the same salary every week. However, under federal law, that salary must be at least enough so that every payroll week he earns at least $7.25 per hour (the current federal minimum wage) for the hours actually worked.  
If the employee works more than 40 hours in a single payroll week, he must be paid overtime, even if he works less than 40 hours in other weeks.

		<description>My question is. I belong to a private club and we have a janitor, his hours fluctuate every week on what there is to do.. We are currnetly paying him a set salery every week. Other members think he should be payed minimum wage times fourty hours per week. He does not always work fourty hours, it just depends on how long it takes him to do sceduled tasks. If he wants to do them in three days or seven that is up to him... Do we have to pay him minimum wage??</description>
