Are employees covered for mental and physical disabilities by the Rehabilitation Act in Wyoming?

The Rehabilitation Act is a federal Act that may apply to employers and employees in the state of Wyoming. When an employer is covered by the Act, then employees that have mental or physical disabilities may also be covered by the Act. However, the employees need to have a record of having a particular disability.

Employers may be covered if they meet at least one of the following requirements for coverage:

·         The employer needs to be a federal government agency, office or contractor working in any branch of the government

·         The employer could be a local or state government agency, office, or contractor working in any branch of the government as long as the employee also receives federal funding

·         The employer could be an educational institution that receives federal funding

·         The employer could also be a public or private employer that receives federal funding

Employers that are covered by the Act should not take a disability into consideration when making any decisions about the employee’s employment status, such as a decision about hiring, promoting, compensating, terminating or otherwise.

Also, covered employers should make reasonable accommodations for employees that have disabilities. For example, if the employee has an addiction and needs to leave work for treatment, the employer should work out a treatment schedule with the employee. If the employee is in a wheelchair and needs a modified work station, the employer should provide one, if it is considered a reasonable accommodation.

Employers may sometimes have to take affirmative action to hire employees with disabilities. For example, if an employer has at least $10,000 worth of federal contracts, the employer should take affirmative action to hire workers with disabilities. If the employee has at least $50,000 and at least 50 employees, the employer should have a written affirmative action plan in place to hire workers with disabilities. CB
