Do we need to post information about the state and federal minimum wages in Virginia, or just one?
The posting requirements for the state of Virginia do not specifically include the Virginia minimum wage, which is $5.85 per hour. However, employers in Virginia are required to post the federal minimum wage information. Keep in mind that the federal minimum wage increased in 2007, 2008 and will increase again in 2009.
The federal and state posting requirements are in place so that employees can have access to information about the labor laws that impact them in the workplace. These labor law posting requirements exist for states across the U.S., including Virginia. However, the major difference from state to state has to do with the state-specific labor law posting requirements. The federal posting requirements are the same in every state.
When an employer posts information about the labor laws, this information should be displayed in an area of the workplace that is visible and accessible to all employees at all times of the day, such as a public bulletin board or even a break room. These labor law posters should not be displayed only in the office of a supervisor, as this could be intimidating to employees.
Employees also should not be discriminated against by the employer for reviewing the information on the labor law posters. Also, contact information for labor law organizations should be on the posters in the event that the employees wish to file a complaint.
The Virginia labor law posting requirements include the following:
· Virginia OSHA - Health and Safety Protection
· Discrimination Notice
· Unemployment Insurance
· Workers Compensation
And the federal labor law posting requirements include the following:
· 2007, 2008 and 2009 Federal Minimum Wage
· USERRA - Uniformed Services Employment and Reemployment Rights Act
· Equal Employment Opportunity is the Law
· Employee Polygraph Protection Act
· Family and Medical Leave Act
· IRS Withholding Notice
· Payday Notice CB
