Does Title VII apply to private nursing homes in Arkansas?
Title VII is part of the Civil Rights Act of 1964, which is a federal Act that applies to employers and employees in states across the country, including those in the state of Arkansas. The Act applies to public and private employers, which may include nursing homes.
According to Title VII, employers may not discriminate against employees or job applicants for reasons that are directly related to gender, race, religion, ethnicity, national origin, or color. Specifically, the employer may not take these factors into consideration when making any employment-related decisions about an employee, such as a decision related to any of the following:
· Hiring
· Promoting
· Compensating
· Training
· Terminating
Employers also may not make decisions based on stereotypes that are related to any of these factors. For example, if a nursing home is hiring new nurses, the nursing home cannot hire employees based on their gender, even though there may be a stereotype about female nurses being gentler than male nurses.
Employees should be able to review their applications if they have any questions about why a decision was made about their employment. For this reason, employers should ensure that all employment-related decisions are based on background information, skills, and references; not based on factors that are covered by the Act. These employee files could be accessed if an employee ever wishes to press charges or question the reasons that he or she was not hired or promoted.
The Act only applies to current employees and job applicants of a covered company. It does not, however, apply to customers or clients of a covered company. Also, the Act only prohibits employers from discriminating against employees for covered reasons. There are other federal Acts that prohibit employers from discriminating against employees for many reasons that are not covered by Title VII. CB
