I’m terminating my employment with a company,  and I have earned vacation time. Am I entitled to that pay if it doesn’t state anywhere in the employee handbook that it will not be paid out upon my leaving?

This will depend entirely upon which state you are in.

 

 

In a number of states, including California and Illinois, terminated employees are always entitled to vacation pay, regardless of what the employee handbook says.

 

In other states, the assumption is that terminated employees will be paid for vacation, unless the handbook states differently. And in still other states, terminated employees are almost never entitled to payment for unused vacation time.
