I live in RI and I pay only a small portion torwards my health insurance. If I go out on TDI for 6 to 8 weeks, what happens to my health insurance? Do I have to try to pay for it all, or just what I am paying now?
The Rhode Island TDI office doesn’t address this issue directly. Some employees will be able to keep their health insurance, others will not.
Many employees can keep their insurance while on Rhode Island TDI or Temporary Disability Insurance, but you may need to pay the entire premium. The policy varies from one employer to another.
That’s partly because a Rhode Island employee who is on temporary disability may also be on unpaid FMLA under federal law. The FMLA allows an employee to keep his or her health insurance – but it applies only to employers with 50 or more workers. The Rhode Island Parental and Family Leave law applies to employers of the same size, and also requires employees to pay the full insurance premium.
