Should salaried employees be paid for sick days?
Not necessarily. Benefits are mostly a matter of company policy. Some employers offer paid sick time, and others do not. Most employers offer 5 or more paid sick days per year, but there is no law requiring it.
If a salaried exempt employee is absent for the entire day, the employer can legitimately withhold pay. This does not endanger the employee’s salaried exempt status. However, if the salaried exempt employee works part of the day – even one hour – the employer must pay the full day’s salary.
Some salaried employees are entitled to overtime pay. These are called salaried non-exempt employees. You as an employer can dock thier pay when absent, even for part of a day.
