Florida - Exempt Salaried Employee
I understand that a salaried/exempt employee cannot be docked for time missed from work if they worked for one hour during that day. However, can we request that the employee make up the time lost from work to catch up with their work that was not completed while they were out?
Yes, salaried exempt workers can be required to make up any work missed while they are out sick. In fact, this is probably the norm for most companies. Salaried workers are often responsible for their entire workload, even if they miss a day. This is true, even if the employee misses the whole day and is not paid for it.
Suppose Jon normally works 5 days per week. Jon is sick on Wednesday and goes home after 1 hour. He must be paid for the entire day. However, the employer can legitimately require Jon to stay late on the other workdays – or to come in on the weekend – to complete his work.
It would be a little more problematic if the employer wanted Jon to put in extra “face time” at the office when there was no work for him to do, no customers to wait on and no employees for Jon to supervise. But it doesn’t sound like that’s the case here.
