Would employees earning a salary and working completely from their own home be exempt from overtime hours? These employee hours are not logged and have no way of being logged, as an employee is permitted to do personal tasks during business hours as long as work is completed. Employees make independent decisions on vendors and locations for event planning and book independent contractors to complete events without supervisor approval.

Generally the location of the work performed doesn’t exempt a worker from overtime. In fact, when an employee telecommutes entirely from home, the US Department of Labor regards the employee’s home as a satellite location of the employer’s office. That’s specifically so the employer can’t claim the worker is an “outside salesperson” and exempt from overtime.

 

 

These administrative employees might be exempt from overtime due to the duties they perform – but only if someone who performed the same duties in your office would also be exempt.
