I am leaving my job soon. I did not give a 2 week notice and now they do not want to pay my earned vacation time. I was told that I would have to work an extra week in order to recieve it. Now there was never a policy that we had to give a two week notice in order to recieve pay. I think that they never paid vacation pay when a person leaves. I never saw anything in writing or heard anything stating that if you are going to quit, give a 2 weeks notice and you will be paid vacation. So do you think I have a case if I do not recieve my vacation pay?

I do not think that you have a case. You don’t mention which state you are in – some states require all employers to pay unearned vacation to terminated employees. However, you do say that your company has never paid vacation on termination.

I think the offer the employer has made – that you will be paid for your vacation if you work 1 more week – is an excellent one, and you should accept it. If you have 2 weeks of vacation time, you will essentially receive 3 weeks salary for working 1 week.
