Can an employee be asked to provide documentation from their physician stating they are currently on a prescription medication that may cause drug tests to show positive, but they are able to work (manufacturing) and the medication won’t affect their ability to do their job?
Drug testing laws vary from state to state. However, the procedure that you suggest sounds entirely appropriate. The alternative would be for the employee to fail a drug test, and be reprimanded or terminated for it. It makes better sense for both the employer and the employee to follow this procedure. Note that the employee’s physician is under no obligation to disclose the employee’s medical condition or diagnosis — only that the employee has a valid reason for testing positive for certain drugs, which do not affect his or her performance.
