Am I entitled to my unused vacation when I quit or am fired? I’m in NYC and I was fired from a temp agency.
This depends entirely upon the employer’s policy in New York. Under state law, every employer must notify employees in writing or by posting the policies in the workplace. If the employer has a written policy of paying vacation, then the New York State Department of Labor will enforce it. It will also enforce oral agreements, when it can prove those agreements.
