We had an employee in our engineering firm, and we had to let him go. Are we required to pay him his vacation time;? We do not have a policy saying that we will pay him. He is insisting to get his paid vacation time, and he said he is going to hire a lawyer so he can get paid. Will you please let me know if he has a case or not?

This will depend primarily upon which state you are in. Some states consider vacation time earned wages, and require all employers to pay them upon termination. (Although if you were in one of these states, you would be required to pay every worker earned vacation pay. So you would likely know by now.) Other states only require that employers pay vacation if they have a written policy or past practice of doing so in similar circumstances.
