As an ice cream franchise in Oklahoma, are we required to pay overtime to the minimum wage, hourly employees?
Oklahoma has no overtime law at the state level. So employers are required to pay overtime at 1.5 times the usual hourly rate when employees work more than 40 hours per week — but only if the federal law applies. Generally, the federal law applies to companies that a) have revenue exceeding $500,000 per year or b) do business across state lines. Many frozen dessert shops will not have revenue over half a million dollars. However, some may purchase from vendors who are out of state. If so, then federal law would apply and employees would be entitled to overtime. To be sure, check with the US Dept. of Labor, Wage and Hour Division concerning your specific situation.
