Is there any law regarding rest/meal breaks in Michigan? If so, what are the time constraints?
There is no federal law requiring rest or meal breaks for employees 18 years old or over. Nineteen states have laws requiring meal breaks for workers over 18. Michigan is not among them. This means that a Michigan employer could require an employee to work for 18 hours without a meal break. That is not a best practice in HR and it is not recommended, but it is legal.
Under federal law, an employee must be paid for any break of less than 20 minutes. Meal breaks that are 20 minutes or longer may be unpaid, as long as the employee is completely relieved of all duties, under both federal and Michigan law. Again, however, they are not required. Under federal law, an employer may require that employees remain on the premises even during unpaid breaks.
