Vacation Accrual Stale Check

I have received a stale check back into our account from ADP on a vacation accrual check that I paid out to a teminated employee back in Dec 2007. Should I contact the terminated employee and have the check re-issued? It is a large amount?

As inviting as it is to keep the money, yes, you should contact the employee and have another check issued. This is one of those cases where not doing the right thing is tempting, but can lead to a lot of problems later. In some states, the employer would be subject to stiff fines for not paying vacation wages that are due. Think of it as karma. The employee is owed the money, you know the employee is owed the money, so you should do the right thing.
