12 week Maternity leave post delivery

Under FMLA is an employee who works upto the date she delivers is the employer then required to provide the employee with 12 weeks of FMLA after the delivery.

Yes. In fact, the employee could take 12 weeks off even if the child was adopted, or a foster child. FMLA, the federal Family and Medical Leave Act permits an eligible employee to take up to 12 weeks of unpaid, job-protected leave for a variety of reasons. One of those reasons is baby bonding. Another is pregnancy and childbirth disability, which is a serious health condition under FMLA.

In this case, assume that the employee is on disability after childbirth for the standard 6 weeks following a routine delivery. Once that period ends, the employee takes 6 weeks of FMLA for baby bonding. Both are covered under the same FMLA request and this is very, very common. This is why many women work until their delivery date — so they have more time to spend at home with the baby after birth.
