Is it against the law to smoke in a retail clothing store in a strip mall?
That will depend upon the state. About 30 states from Oregon to New York have laws that prohibit smoking in the workplace. Smoking is prohibited, even if there is only one employee in the store, and she is the one smoking.
Even in states where workplace smoking may be legal, the employer has the right to restrict smoking. Most retailers would not allow smoking in the store, because they do not want the merchandise to reek of smoke.
Even if the state and the employer permit smoking, the property owner might not. In most enclosed malls, for example, smoking is prohibited by the property management company that owns the mall.
