Does Texas require employers to give employee paid maternity leave?

No. There is no Texas family leave law. Under the federal FMLA, or Family and Medical Leave Act, many employees are entitled to up to 12 weeks of unpaid, job-protected leave for a variety of reasons. These reasons include childbirth disability. Mothers or fathers are also permitted to take FMLA to bond with a new baby during the childs first year of life. However, the leave is limited to 12 weeks total in a 12-month period, and it is unpaid and this law applies only to employers with 50 or more workers within 75 miles.

There is no state in the U.S. that requires employers to give paid maternity leave to employees. Five U.S. states have mandatory short term disability that covers childbirth disability: California, Hawaii, New York, Rhode Island and New Jersey. California also offers paid parental leave to parents of both sexes. But in all those cases, the benefits are paid by the state, not by the employer.
