Is it a state law in Virginia to have a job file for each position posted, and what is necessasry to have in the job file?

No, there is no law in Virginia that addresses this issue. The best practice in HR is to have a job description, and a list of qualifications on hand before posting or advertising the job. Applicants should be assessed based on a clear list of objective criteria. The employer should be able to document why the person hired was the best candidate for the job, to avoid discrimination claims. Whether or not all of this information is kept in one file, is a matter of company policy.

However, no employer should discard applications, especially those from candidates who were not hired. They should be retained for 7 years.
