If payday is May 10 can the employer hold checks until May 11?

This will depend upon which state you are in. A number of states, including Texas, Illinois and California have “payday” laws. These laws require that the employer pay workers on payday. Other states have laws that salaried employees must be paid at least once per month, and hourly employees must be paid at least twice per month. Some states have laws that specify that employees must be paid within 5 days of the end of the payperiod.

But other states have no payday law. The federal FLSA or Fair Labor Standards Act (the federal minimum wage law) requires that you pay employees — but does not specify when you must pay them.
