Does Alabama require employers give employees breaks or lunches? And if so is it job specific?

Alabama has no law requiring meal or rest breaks. Nineteen US states do have such laws, but Alabama is not one of them.

Federal law does not requie meal or rest breaks, but it sets some limits for employers who choose to give those breaks. Under federal law, a break of less than 20 minutes must be paid. A meal break longer than 20 minutes can be unpaid if the employee is relieved of all duties.

Federal worker safety standards set break requirements in a few occupations like airline pilots and long-haul truckers. There are break standards established by OSHA for employees working outdoors in hot weather. But the majority of occupations are not covered.

Can Alabama employers force you to clock out for breaks such as bathroom, smoke, or coffee breaks?

  2. Caitlin Says:

Hi Tina! Not if the employer is covered by the federal minimum wage law, and the break is less than 20 minutes. HTH, and thanks for reading the blogs!~ Caitlin
