IF A school employee ie teacher is put on FMLA in the spring of 09 and returns with restrictions from the same incident in the fall of 09 Do we count the FMLA already taken in the spring or start over in the fall with another 12 weeks?

This will depend upon the FMLA calculation method that your school district uses. There are 4 different calculation methods that an employer can choose from. However, by far the most common would be for the employer to count FMLA beginning on the employees first day of leave taken. If the employee took 12 weeks of FMLA beginning April 14, 2008, she would qualify for FMLA again on April 14, 2009. It is very, very unusual for FMLA to be calculated by the school year.
