How should I respond to these questions from an employee:

(1) I was told that fmla hours for part time employees has been reduced to 300 hours , is this correct.

(2) if so are the requirements still 1250 hours work?

(1) No. FMLA is and always was 12 WEEKS. That is 12 weeks based on the number of hours that the employee usually works per week. An employee who works 40 hours per week has 480 hours of FMLA (12 weeks x 40 hours = 480.) An employee who works 25 hours per week has 300 hours of FMLA (12 x 25 = 300.) An employee who works 10 hours per week has 120 hours of FMLA. (12 x 10 = 120.)

(2) Yes, the requirements for an employee to qualify for FMLA are:

a) the employee must have worked for the employer for at least 12 months

b) the employee must have worked at least 1,250 hours in the past 12 months
