Time Card Fraud and Termination

If I were to terminate an employee for cheating on their time. We keep our time by signing onto and off of their work station computer. Can that employee still collect unemployment?

Usually when an employee intentionally violates company policy, and is terminated for it, the employee does not qualify for unemployment. In this case, lying about the time worked is clearly a case of misconduct. Timeclock fraud and falsifying payroll records, are very serious offenses because they are essentially stealing from the employer.

The various state unemployment agencies are not always predictable, but if the employee lied about when they were at work, then usually they would not qualify for unemployment benefits. If this employee is awarded unemployment, you should contest it.
