Certified FMLA vs New Illness
If an employee has supplied FMLA paperwork regarding an Asthma condition and they claim an FMLA day to schedule a Dentist appointment for a swollen face/neck or does FMLA only apply when the appointment is directly related to the Asthma condition?
Yes, the FMLA only applies for an appointment that is directly related to the FMLA condition — in this case, Asthma. Unfortunately, employees sometimes treat FMLA as if it were a free pass to take time off whenever they like, for any reason. This is not true.
If the employee has a second serious health condition that requires her to take time off work, she needs to have the dentist complete FMLA paperwork for that condition.
The total time the employee can take off for all reasons combined is still 12 weeks.
