Are exempt employees required to clock inout for work and in/out for lunch?

There is no federal or state law that requires exempt employees to clock in and out. Most companies do not require that exempt employees use the time clock, but this is a matter of company policy, not employment law. You as an employer can require that exempt employees clock in and out if you like. You can discipline or terminate any exempt employee who does not follow this procedure. There are several legitimate reasons why an employer would want to monitor the hours that exempt employees work.

If you applied this policy only against a protected group, that would be illegal discrimination. For example, you could not require that Hispanic exempt employees clock in and out, but not employees of other groups.
