When filing past employee documents what items do we need to keep in personnel file and what items are to be kept seperate???
Can we merge I-9 forms and medical into this or do they still need to be kept seperate??

The standards for HR files for former employees are the same as for current employees so no, the information should not be merged.

Medical information should always be kept in a separate confidential file under ADA regulations. If you keep only the I-9 forms, then they can also be in the confidential file, separate from the employee personnel file. However, the law permits you to copy the I-9 supporting documents. If you do so, then the I-9 form and supporting copies should be kept in a separate file from the confidential file. You can I-9 information for all employees together in a single file or binder. This information should be retained for at least 3 years after the employee leaves the company.
