Is it legal for us to ask salary exempt employees to work more then 40 hours per week?

Yes, this is completely legal in all 50 states. Under the federal FLSA or Fair Labor Standards Act, an exempt salaried employee is never entitled to overtime. The employer can require the worker to put in 60, 70, 80 or more hours per week. The employee must be paid his or her usual salary, but need not receive any additional pay for the extra hours.

You can require that an exempt employee work 60 or more hours per week, every week. If the exempt employee does not comply, you can discipline or terminate him or her. This is lawful in all states.
