If you hire employees as PRN (on an as needed basis) are they eligible for unemployment benefits? If so, how is this determined - by the hours they sign up for to work or the hours they actually work?

That depends. Temporary staff members are not entitled to unemployment benefits. So if you hired a PRN employee on a temporary basis, he or she would not be entitled to overtime. However, permanent staff members are often entitled to overtime, even when they have no fixed schedule.

Unemployment benefits are determned by the number of hours that the employee actually worked (and the wages earned) over the past 15 months, in most cases. The fact that the employee was willing to work additional hours, but no hours were available, is not really relevant.
