Can a company in Virginia require an employee to take a lunch break? The company schedules extra 30 minutes for lunch breaks and does not pay for them. Some of the employees work 8 hours and leave. They are being told that they have to take a 30 minute lunch break. Can they be made to take that 30 minute break?

Yes, an employer in any state can establish a policy that employees must take an unpaid lunch break. If the employee refuses to take the lunch break, the employee can be disciplined or terminated. If the employee does skip his or her lunch break, there is no requirement that the employer must permit the employee to go home early. The employee can also be disciplined or terminated for not working the full shift.

Many employees assume that if they skip their half-hour lunch, they can go home a half-hour early. In fact, the two are completely unrelated. In either case, the employee is violating company policy and can be terminated.
