Is there an FMLA form for a disease with no cure, a permanent condition or does the employee have to renew every 6 months? Our company requires that employees recertify every 3 months, can they do that?
No, there is no permanent FMLA form. The FMLA regulations were changed in January 2009. Under the new regulations, an employer can require recertification every 6 months, even for a permanent condition like migraines or epilepsy. This means that the employee has to have a doctor complete FMLA forms every 6 months.
If your company is requiring recertification every 3 months for an ongoing condition, you are in violation of the FMLA regulations.
