Family Medical Leave form WH-380-E
Does an employer need to reply back to an employee on a family medical leave request? If so what are the stipulations on time frame of response? Thanks!
Yes. Under the current FMLA regulations, there is a specific time frame for the employer to reply, when an employee has requested FMLA.
Under the regulations put in place in January 2009, the employer must notify the employee of his or her rights under FMLA, in writing, within 5 business days of any absence that could be eligible. The employee then has 14 days complete the required forms and return them. Then the employer has 5 days to inform the employee, in writing, of the decision to grant FMLA or deny FMLA. Or, the employer can inform the employee in writing that additional information is needed, and what that information is.
Any employer who does not respond within 5 business days is in violation of the FMLA regulations, which are enforced by the U.S. Department of Labor.
