Is a cosmetology instructor in South Carolina that gets paid by the hour, exempt or nonexempt.

Any employee who is paid by the hour is non-exempt under the federal FLSA or Fair Labor Standards Act.  Only some salaried employees (with certain job duties) can be exempt from overtime under federal law.

However, you may not have to pay this employee overtime. South Carolina has no minimum wage or overtime law. If your company has less than $500,000 in annual revenue and does not engage in interstate commerce, then you are not covered by the federal overtime law, the FLSA. In that case, you could pay this employee straight time for all time worked.
