When an employee is covered by WC and FMLA simultaneously do we need to continue retirement contributions and service credit?
This is a matter of company policy, but usually FMLA does not count as time worked towards accruing vacation, sick leave, etc. Whether or not you continue retirement contributions will depend upon how you normally handle the situation when an employee takes time off under workers comp. There is no legal requirement that you must continue retirement contributions. If you have continued contributions for other employees on workers comp in the past, then you should do the same for an employee who is also on FMLA.
