A 40 hr per week employee (8 hrs a day Mon-Fri) has worked 34 hrs Mon-Thurs. He has a sick or vacation day on Fri, submits a leave request for 8 hrs, but only needs 6 hrs to make 40. Must we pay him for 42 hrs or can we reduce his leave time to 6 hrs thus making 40 hrs and staying within budget?

It is a matter of company policy whether you will permit employees to use partial days of leave. Most employers do permit it employees to use partial days of leave. Also, most employers do not permit an employee to use leave time in excess of their normal work week. Example: Suppose Tamika normally works 40 hours per week. She would not be entitled to work 35 hours and use 8 hours of leave, totaling 43 hours.

However, this is a matter of company policy. If you have a policy in place that employees can only use full days of vacation or time off, then this may be permitted.

Obviously if you use only 6 hours of this employees leave time, he will still have 2 hours that he can use at a later date.
