Is taking 2 weeks prior to delivery but not already have delivered a child covered under the FMLA Law…. can the employee legally take time off before the baby is actually born?

Yes, both pregnancy and childbirth are covered by FMLA. Many doctors will recommend that a pregnant woman take time off from work in the last month of pregnancy, especially if she has a job that is physically demanding.

However, the mother receives only 12 weeks of FMLA total for all reasons in a 12-month period, including prenatal appointments, pregnancy, childbirth and to care for the newborn. So a mother who takes off 2 weeks prior to delivery will have only 10 weeks to stay home with the infant after birth. A mother who works until delivery will have 12 weeks to stay home with the infant after birth.
