In the majority of states, it is legal for you as an employer to have a use-it-or-lose-it policy where employees must use PTO or vacation by a certain date (usually their anniversary or the last day of the calendar year) or forfeit it. However, in many cases you must have such a policy in writing before the PTO is earned.

In California (and arguably in a few other states) employees must be paid for any PTO time forfeited under this policy. In most other states, the PTO time simply evaporates if it is not used.
