Is it legal for an employer to ask an employee what they are sick with when they call in sick?

The EEOC warns against employers against routinely asking for medical information. Employers can be within their rights to inquire further if they have a valid reason for suspicion that the time of was not taken legitimately. Requiring a doctor’s note for employees using sick days is not considered best practice either as it may violate the ADA in some situations.
