Vacation Payout

We have an employee who is a California employee. He is resigning and moving to Pennsylvania. Do I still need to pay him his accrued vacation immediately upon termination (as per California law) or can I include it in the next pay cycle since he is moving to Pennsylvania?

Even though the employee plans to move to Pennsylvania in the near future, he is still a California employee and you are still required to follow California law. That includes paying him for all accrued but unused vacation within 24 hours of termination.

If the employee was working in Pennsylvania for a company based in California, that would be a different situation.
