pto hours after reignation

In the state of new Mexico I chose to quit my job after working there for 1 year and seven months without any notice. I had 37 hours of pto hours earned but the company refuses to pay me for them since I gave no notice. Is that legal?

The US Department of Labor (FLSA) does not require payment for time not worked such as vacations, sick leave or holidays. These benefits are a matter of agreement between employer and employee. In New Mexico an employer is required to pay for time worked within 5 days after termination. PTO time is considered a benefit and payment is not required. Yes, it is legal for them to withhold the PTO time.
