Can grand parent take FMLA for her daughter having a baby?

Generally no, grandparents are not eligible for FMLA for the birth of a grandchild.

However, certain circumstances may entitle a grandparent to FMLA time off. If the grandparent assumes the day-to-day care or financial support and can establish a loco patentis relationship where the grandparent intends to assume the responsibilities of a parent with regard to a child, FMLA may be granted. The grandparent (employee) must prove the particular facts sounding the relationship. The employer may require documentation or statement of the family relationship.
