FMLA-business just over 50 employees

Our company is growing quickly, and will soon have more than 50 employees and will be required to follow FMLA law. When does this requirement kick in? The day our 50th employee is hired? Or the following month or year? (In Texas)

You will need to start following the FMLA requirements when you employ 50 or more employees for at least 20 workweeks in the current or preceding calendar year. In your situation it will be the date you employee 50 employees then count 20 workweeks.

Eligibility for employees will be that they worked for you for at least 12 months and have worked at least 1,250 hours during those 12 months. Therefore your newly hired employees would not be eligible until 12 months of employment. However, employee who have worked 12 months and 1,250 hours are eligible to begin using FMLA.
