Travel time

Do you have to pay overtime on travel time in SD? If an employee travel job site to job site during the course of a day, do the travel hours have to count towards the OT calculation?

Federal rules apply because South Dakota does not have overtime rules. Overtime is paid after 40 hours of work during a workweek. Federal law also states that time spent traveling during a normal work week is considered compensable work time.

Therefore yes, if the employee worked more than 40 hours because of the travel time, those hours spent traveling would count towards overtime.
